1. Introduction and Acceptance

Welcome to PixeBuilder. By downloading, installing, purchasing, or using the PixeBuilder software (including the Free version available on WordPress.org and the Paid "Pro" versions), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our software.

2. Business Identity and Governing Law

The Provider: PixeBuilder is developed and operated by the PixeBuilder Team, a business legally registered in Thailand.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Thailand.
Server Location: You acknowledge that our servers are located in Germany and that data processing related to account management, updates, and template libraries occurs in this jurisdiction.

3. Licensing and Usage Rights

PixeBuilder operates on a "Freemium" model.

3.1 The Free Version

The free version of PixeBuilder is available via the WordPress.org repository and is licensed under the GNU General Public License (GPL).

3.2 Paid Subscriptions (Pro, Plus, Agency)

Access to premium features, templates, and support is provided via a paid subscription. Usage is strictly limited based on the plan purchased:

Pro Plan: Valid for use on 1 website.
Plus Plan: Valid for use on 5 websites.
Agency Plan: Valid for use on 50, 100, or 500 websites (depending on the specific tier purchased).

You may not resell, redistribute, or share your license key. Doing so is a violation of these terms and will result in immediate termination.

4. Payments, Renewals, and Refunds

4.1 Merchant of Record

Our order process is conducted by our online reseller, Paddle.com. Paddle is the Merchant of Record for all our orders. Paddle handles all customer service inquiries regarding payments, tax collection (VAT), and invoices.

4.2 Automatic Renewal

Unless you cancel your subscription before the end of the applicable subscription period, your subscription will automatically renew. You authorize us (via Paddle) to collect the then-applicable annual subscription fee using the payment method we have on record.

4.3 30-Day Refund Policy

We offer a 30-day money-back guarantee on all new subscriptions.

No Questions Asked: If you change your mind within 30 days, you are eligible for a full refund.
Procedure: To request a refund, you must submit a request via the Contact Form on our website. Please do not send refund requests via direct email, as they may be missed.

5. Software Updates and Support

5.1 Support Channels

Support is provided strictly via the Contact Form on our official Contact page. We do not provide support via direct email, social media, or other channels.

5.2 Updates and Expiration

You are entitled to software updates (including security patches) and technical support only while your subscription is active. If your subscription expires:

You may continue to use the version of the software you currently have installed.
You will immediately lose access to new updates, the template library, and technical support.

6. Fair Use of Cloud Resources

Access to our online Template Library and Update Server is provided for reasonable, manual use within the PixeBuilder interface. You are strictly prohibited from:

Using automated scripts, scrapers, or bots to bulk-download templates or assets.
Attempting to reverse-engineer or overload our validation API.
Reselling access to our Template Library to third parties.

Violation of this policy may result in the immediate suspension of your license and IP address blocking, without refund.

7. Account Security

You are responsible for maintaining the confidentiality of your login credentials and license keys. You are fully responsible for all activities that occur under your account. We will not be liable for any loss or damage arising from your failure to protect your account information.

8. User Generated Content

PixeBuilder is a tool that allows you to create web content. We do not claim ownership of the content you create. You are solely responsible for ensuring that the websites you build comply with all applicable laws. We expressly disclaim liability for any legal claims arising from content created or hosted by you using our software.

9. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY TO YOU.

9.1 "As Is" Basis

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Liability for Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PIXEBUILDER TEAM, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES, BUT IS NOT LIMITED TO:

DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA.
WEBSITE DOWNTIME OR TECHNICAL FAILURES.
CONFLICTS WITH THIRD-PARTY PLUGINS, THEMES, OR SERVER CONFIGURATIONS.
COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.3 Third-Party Compatibility

WE DO NOT GUARANTEE THAT PIXEBUILDER WILL FUNCTION PERFECTLY WITH ALL THIRD-PARTY PLUGINS, THEMES, WEB BROWSERS, OR HOSTING ENVIRONMENTS. WE ARE NOT RESPONSIBLE FOR ANY ISSUES ARISING FROM INCOMPATIBILITY WITH OTHER SOFTWARE INSTALLED ON YOUR WEBSITE.

10. Termination

We reserve the right to terminate your license immediately and without refund if:

You are found distributing, sharing, or selling your license key or the PixeBuilder Pro files (e.g., on "nulled" or "warez" sites).
You breach any part of these Terms and Conditions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes (such as price increases), we will notify you through our website or via email. Your continued use of the software after such changes constitutes your acceptance of the new Terms.
